DATE : 23rd JULY, 2025 P.C.:- 1) Present Petition was called out for hearing in the afternoon session. At the outset, learned A.P.P. has drawn our attention to the Judgment dated 14th October, 2024 passed by the Division Bench of this Court in Criminal Writ Petition No. 2618 of 2023 dismissing the said Petition on merits. The said Judgment was challenged before the Hon'ble Supreme Court by way of Special Leave to Appeal (Crl.) No(s). 16788 of 2024. The Hon'ble Supreme Court by its Order dated 6th December, 2024 has dismissed the said Special Leave to Appeal confirming the Judgment dated 14th October, 2024.

2) In this precise background, we had directed Advocate Mr.Ratan 1/2

KVM 45 - APL 780-2025.doc Adhe who is holding for Advocate Ms.Poonam V. Bodke-Patil to take instructions as to either withdrawal of Application or for its dismissal with cost. The Application was accordingly kept back and called out for hearing at 5:15 p.m. At that time, Advocate Mr. Ratan L. Adhe again requested this Court to adjourn the matter.

3) We do not appreciate the practice adopted by the Advocate on record for the Applicant. However, at the request of Advocate Mr.Ratan Adhe, we are adjourning the Application on 31st July, 2025, subject to payment of Rs.10,000/- to be paid to Kirtikar Law Library, High Court, Mumbai.

3.1) The said cost be paid on or before 29th July, 2025, failing which, Application shall stand dismissed without further reference to this Court.
