P.C.:- 1) By this Application under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023, the husband (Applicant No.1); mother-in-law (Applicant No.2); father-in-law (Applicant No.3); brother-in-law (Applicant No.4); sister-in-law (Applicant No.5-wife of Applicant No.4) and aunt of the Applicant No.1 (Applicant No.6) are seeking quashing of R.C.C. No.682 of 1/2
DDR 36 APL 781 2025.doc 2021, pending on the file of the Joint Civil Judge Junior Division and the Judicial Magistrate First Class (Court No.7), Pune, arising out of C.R. No. 442 of 2020, dated 2nd May 2020, registered with Samarth Police Station, Pune, for the offences punishable under Sections 323, 498-A, 504, 506 read with Section 34 of the Indian Penal Code, with the consent of Respondent No.2, i.e. the wife of the Applicant No.1.
2) Mr. Pathan, learned Advocate for Respondent no.2 appearing through video conferencing, informed this Court that the Respondent No.2 has already filed on record her Affidavit dated 27th June 2025, duly affirmed before a Notary Public. In the said Affidavit, it is stated that, the Applicant No.1 and Respondent No.2 have jointly filed the Consent Terms dated 7th May 2025, before the Family Court at Pune in Petition No.A-959 of 2020, thereby finally resolving their disputes amicably. In Paragraph No.5 thereof, the Respondent No.2 has given her no objection for quashing of the crime in question.
2.1) Respondent No.2 is personally present in the Court and through her Advocate reiterates the contents of her Affidavit dated 27th June 2025 and her 'No Objection' for quashing of the crime in question. 3) In view of the above, the Application is allowed in terms of prayer clause (a).
