DATED : 17th SEPTEMBER, 2025 P.C. :- 1) This is an Application for quashing of the proceedings in respect of RCC No.37 of 2022, before the learned J.M.F.C. Belapur arising out of C.R. No.148 of 2021 registered on 27th July, 2021 at C.B.D. Belapur Police Station under Sections 354, 354A, 354B, 354D and 506 of the Indian Penal Code, 1860.

2) The prayer is made for quashing by consent. Since the matter is settled, it is not necessary to refer to the allegations in the F.I.R. in detail. The F.I.R. was lodged by the Respondent No.2 on 27th July, 2021. The Petitioner is her father-in-law. She has stated that she got married with 1/3

Manoj 904-APL-921-2025.doc the Petitioner's son on 6th February, 2013. The F.I.R. mentions two specific instances dated 8th December, 2019 and 26th June, 2021. According to her, on both these occasions, the Petitioner had behaved indecently and had outraged her modesty. On these allegations, the F.I.R. was lodged. The investigation was carried out and the charge-sheet was filed. The chargesheet contains statements of the househelps. They have not exactly supported the allegations in the F.I.R. Be that as it may, now the parties have settled the matter. The Respondent No.2 has filed her Affidavit giving consent for quashing of the proceedings. She appeared before the Court through video conferencing. She was identified by her learned Counsel.

She has stated in her Affidavit that there was a family arrangement made through a Memorandum dated 12th July, 2025. They have arrived at an amicable settlement. She has resolved the dispute with the Applicant and she is not desirous of continuing with the present proceedings, which are the subject matter of the present Application. She stated before the Court through video conferencing that, she did not want to proceed further with the prosecution and she has no objection for quashing of the proceeding. 3) Considering that the matter is completely settled between the parties, no purpose would be served in continuation of the Criminal prosecution. It deserves to be quashed in the interest of justice and in the interest of the parties. Therefore, we are inclined to allow this Application.

(i) The F.I.R. registered at C.B.D. Belapur Police Station, vide C.R. No.148 of 2021 dated 27th July, 2021 under Sections 354, 354A, 354B, 354D and 506 of the I.P.C and further proceedings arising out of the same, are quashed and set aside.
