In view of the urgency sought to be put forth by Mr. Jatin Sehgal, learned Advocate for the Applicant, circulation was granted post lunch.

This matter was taken up after the "Fresh Admission Board". 3.

Heard Mr. Jatin Sehgal, learned Advocate for the Applicant, Mr. Tanveer Khan, learned A.P.P. for the State/Respondent and Mr. Kunal Chheda, learned Advocate for Respondent No. 2. 4.

By the present Criminal Application, the Applicant has sought for the following substantive reliefs in terms of prayer clauses 21(a) & (b) :-

allow the present Application and quash the summoning order dated 01.03.2025 passed by the Ld. Judicial Magistrate (First Class), 71st Court, Bandra, Mumbai in C. R. 901 of 2024 titled as "Vakola Police Station vs Vishal Prabhu Motwani & Anr.";

b.

allow the present Application and quash any and all proceedings arising out of or in relation to C. R. 901 of 2024 titled as "Vakola Police Station vs Vishal Prabhu Motwani & Anr." pending before the Ld. Judicial Magistrate (First Class), 71st Court, Bandra, Mumbai."

Mr. Jatin Sehgal, learned Advocate for the Applicant on instructions from the Applicant craves leave to withdraw the present Criminal Application in view of the settlement arrived between the parties during pendency of this Criminal Application. 6.

Mr. Tanveer Khan, learned A.P.P. for the State/Respondent does not object to the request of withdrawal of the present Criminal Application made by Mr. Jatin Sehgal on behalf of the Applicant.

In view of the above, leave granted to withdraw the present Criminal Application.
