It is stated at the Bar that cognizance of the offence has been taken by the Court concerned. In that view of the matter, the criminal application shall not be maintainable by the Division Bench of this Court and the applicant is required to challenge the order taking cognizance before the jurisdictional Court. 2.

Therefore, the learned counsel for the applicant seeks permission to withdraw this Criminal Application with liberty to challenge the order taking cognizance before the appropriate forum. 3.

Criminal Application No.944 of 2025 is dismissed as withdrawn with liberty as prayed for by the applicant. 4.

However, we may indicate that withdrawal of this Criminal Application by the applicant is for technical reasons and this should not be construed as reflection by this Court on the merits of the matter.
