Heard the learned Counsel for the parties.

This application is preferred seeking modification of the condition of bail.

The applicant is arraigned in CR No.250 of 2024 registered with Deonar Police Station, Mumbai, for an offence punishable under Section 22 read with 8(c) of the Narcotic Drugs and Psychotropic Substances Act, 1985, ("NDPS Act"). 4.

By an order dated 2nd May, 2024, the learned Special Judge directed the release of the applicant on bail on the condition of furnishing a solvent surety and the PR Bond in the sum of Rs.70,000/-.

As the applicant could not furnish surety, an application for modification of the condition was filed. By an order dated 18th July, 2024 the said application came to be rejected.

The applicant is now seeking modification of the condition only to the effect that, the applicant be permitted to furnish one or more sureties in the amount of Rs.70,000/-. 7.

Having regard to the time that has elapsed since the order dated 2nd May, 2024 directing the release of the applicant on bail, the prayer of the applicant seems justifiable. Otherwise, it would amount to denial of bail to the applicant.

Hence the following order:

: O R D E R :

(i) Application stands allowed.

(ii) The applicant be released on bail on furnishing a PR Bond in the sum of Rs,70,000/- with one or more sureties in the like amount.

(iii) Rest of the conditions of bail remained unaltered. Application disposed.
