By this application, the applicant prays for the following reliefs:- "a.

This Hon'ble Court may be pleased to quash and set aside the FIR bearing C.R. No.976 of 2025 for the offences punishable u/Sec. 125, 189(2), 190, 191(2), 191(3), 351(2), 352 of the BNS, Sec. 4 & 25 of the Arms Act, 1959, Sec. 3(1) (r), (s) & Sec. 3(2)(va) of the SC/ST Act and Sec. 37(1) & 135 of the Maharashtra Police Act, 1951 registered by the officers of Shanti Nagar Police Station.

b.

Without prejudice to the above and in the alternative, this Hon'ble Court be pleased to quash Sec. 3(1)(r), (s) & Sec. 3(2) (va) of the SC/ST Act as included in the FIR vide C.R. No.976 of 2025 registered by the officers of Shanti Nagar Police Station.

c.

Pending the hearing and final disposal of the present petition, this Hon'ble Court may be pleased to stay the further investigation in FIR bearing C.R. No.976 of 2025. d.

Ad-interim relief in terms of prayer clause (c)." 2.

Mrs. Mahalaxmi Ganapathy, the learned Additional Public Prosecutor states that cognizance of the offence has been taken by the Court concerned.

3. In view thereof and considering Rule 2(II)(h) under Chapter I of 1/2 902-APL-995-2025.doc Dixit

the Bombay High Court Appellate Side Rules, 1960, the learned counsel for the applicant seeks permission to withdraw this criminal application with liberty to file fresh petition/application, if so advised.
