By the present Application, the Applicant has sought the following substantive relief :- "(b) Quash and set aside the Chargesheet filed against accused no.1 )Exhibit-B) in RCC No.7102311/2021, pending on the files of Hon'ble COURT OF 71st ACJM BANDRA, MUMBAI which is arising out of FIR No.632/2017, registered by the Respondent Santacruz police station for offences punishable under Sections 294, 114, 34 and sections 2, 8(1)(2)(4) of the Maharashtra

Mr. Manas Gawankar learned Advocate for the Applicant, on instructions from the Applicant, craves leave to withdraw the present Application with liberty to file an Application seeking discharge before the Trial Court at the appropriate stage.

The request made by Mr. Manas Gawankar learned Advocate for the Applicant, is not opposed by Mrs. Rajeshree Newton learned APP for the Respondent/State.

In view of the statement made by Mr. Manas Gawankar, learned Advocate for the Applicant, leave granted to withdraw the present Application with liberty as prayed for. 6.
If an application seeking discharge is filed before the Trial Court at the appropriate stage, the same be considered on its own merits and in accordance with law. 7.
