Heard the learned Counsel for the parties.

The Applicant is aggrieved by an order dated 14 August 2025 passed by the learned Special Judge, whereby the application of the Applicant for exemption came to be rejected.

Learned Counsel for the Applicant submits that, on the very same day, learned Special Judge has passed an order of issue of NBW against the Petitioner. Learned Counsel submitted that the Applicant is ready and willing to appear before the learned Special Judge.

4.

Roznama of the proceedings indicates that the other accused are also not appearing before the Special Court, and, therefore, warrants have been issued against other accused as well.

As the Applicant has shown willingness to appear before the learned Special Judge, the applicant deserves limited protection. SSP 1/2

The applicant shall appear before the learned Special Judge on or before the next date.

7.

If the Applicant appears before the learned Special Judge and files an application for cancellation of NBW, learned Special Judge is requested to consider the same in view of the willingness of the applicant to regularly appear before the Special Court.

8.

Till the next schedule date before the learned Special Judge i.e. 28 October 2025, the execution and operation of the NBW issued against the Applicant stands stayed.

Criminal Application stands disposed.
