The present Criminal Application is filed under section 528 of the Bhartiya Nagarik Suraksha Sanhita, 2023 seeking the following relief:
"(b) The Hon'ble Court be pleased to quash the entire proceedings in FIR No.25/2025 under sections 498(A), 313, 406, 323, 504, 506, 34 of IPC registered by Mira-Road Police Station and in Case No.RCC/4272/2025, which is pending before Ld. J.M.F.C. 1st Civil Judge Junior Division at MiraBhayandar Court at Mira-Road and next date of hearing is 17/09/2025."

The applicant no.1 is the husband of the respondent no.2 and has filed this present criminal application through his Power of Attorney holder. The applicant nos.2 to 4 are the family members of the applicant no.1. Due to marital discord between the applicant no.1 and the respondent no.2, several disputes arose between the parties.

On 15th January 2025, an FIR bearing CR No.25 of 2025 was registered with the Mira Road police station at the behest of the respondent no.2 for offences punishable under sections 323, 406, 498A, 504, 506 and 34 of the Indian Penal Code 1860. The proceedings arising therefrom are pending before the learned 1st Judicial Magistrate First Class, Mira Bhayandar bearing RCC/4272/2025 wherein charge-sheet dated 3rd June 2025 has been filed. The applicants have been granted anticipatory bail by the learned Sessions Court at Thane by order dated 4th April 2025. 4.
The parties have now amicably settled their disputes. The same is recorded in the consent terms dated 8th September 2025 filed before the learned Family Court at Vasai which is annexed as Exhibit "F" to this petition. The consent terms record that the parties have decided to part their ways and have decided to file petition to dissolve their marriage by mutual consent. The settlement regarding permanent alimony and the payment schedule for the same have also been arrived at. It is also on record that part-payment towards the same have been made. 5.
The parties are present in the Court and identified by their respective counsel. The parties have affixed their signatures and have recorded their appearance in their own handwriting which shall form part of the record. A copy of the Aadhaar Card of the respondent no.2 is also taken on record. Mr. Thakur, the learned counsel for the respondent no.2 has tendered an affidavit dated 19th November 2025 which records that the respondent no.2 has no objection to quashing of the said FIR and any proceedings arising therefrom.

As held by the Hon'ble Supreme Court in "Rangappa Javoor v. State of Karnataka" 2023 SCC OnLine SC 1736 it is a well2/3
settled position that in cases of offences relating to matrimonial disputes, this Court may, for the purpose of securing the ends of justice, quash the criminal proceedings between parties by exercising its inherent powers, provided the Court is satisfied that the parties have settled the disputes amicably. In light of the said position of law and the settlement between the parties, Criminal Application No.1200 of 2025 is allowed in terms of prayer clause (b).
