Heard the learned Counsel for the applicants. 2.

A limited prayer in this application is to direct an expedite hearing of Criminal Appeal Nos.301 to 304 of 2019 preferred by the applicants, which are pending on the file of the learned Additional Sessions Judge, Borivali Division. 3.

The appeals are preferred by the applicants against the judgment and orders passed by the learned Magistrate, thereby convicting the applicants for an offence punishable under Section 138 read with Section 141 of the Negotiable Instruments Act, 1881.

The learned Counsel for the applicants invites attention of the Court to roznama of the appeal proceedings dated 25th January, 2024, wherein it is recorded that, the Advocate for the appellant had filed written argument and list of citations. It is submitted that the pendency of the appeals is causing grave prejudice to the appellant No.2, who is the resident of Hyderabad.

Having regard to the pendency of the appeals since year 2019 and the fact that the appeals were taken up for hearing and written arguments were filed on behalf of the appellants on 25th January, 2024, the prayer for expedite hearing of appeals appears justifiable.

The Court is informed that, the appeals are now scheduled to be listed on 20th December, 2025.

The application stands partly allowed.

The learned Additional Sessions Judge seized with Appeal Nos.301 to 304 of 2019 is requested to hear and decide the appeals as expeditiously as possible and, preferably, within a period of six months from the next scheduled date. 9.

The application stands disposed.
