Heard the learned Counsel for the parties.

A limited prayer in the application is to direct the trial Court to decide Case CC No.812/PW/2018 in a time bound manner. 3.

Learned Counsel for the Applicant submits, that the first witness was examined on 23 September 2022. Thereafter, the case has been adjourned on more than 25 occasions and the prosecution has not examined any witness thereafter. The applicant is 60 years of age and the pendency of the proceeding is causing grave prejudice to the applicant. 4.

The grounds raised in the application appear to be justifiable. It seems that first witness was examined way back in September 2022. The Court, thus, considers it expedient to request the learned Magistrate to hear and decide CC No.812/PW/2018 as expeditiously as possible. SSP 1/2

The Application, thus, stands disposed with a request to the learned Magistrate seized with CC No.812/PW/2018 to hear and decide the said case as expeditiously as possible and preferably within a period of one year from the next date scheduled before the trial Court.
