Heard the learned Counsel for the parties.

The Applicant is aggrieved by the orders of issuance of non-bailable warrant and proclamation against the Applicant. 3.
Learned Counsel for the Applicant invites attention of the Court to Roznama of the proceedings before the learned Magistrate. The Digitally signed by SWAROOP SHARAD PHADKE Date:
2025.12.19 12:24:11 +0530 proclamation was ordered to be issued against the Applicant in the year 2017. SWAROOP SHARAD PHADKE Thereafter, it appears, the Applicant filed an application before the learned Magistrate and execution of the NBW came to be stayed in the year 2020, albeit, till the next date.

Learned Counsel for the Applicant submits that the Applicant will appear before the learned Magistrate on the next scheduled date of the listing of CC No.PW/506/2017, and undertakes to, thereafter, appear before the trial SSP 1/2

The Court finds that the Applicant and the co-accused are facing prosecution for the offences punishable under Sections 409 and 420 read with Section 34 of the Indian Penal Code, 1860. The Applicant is a woman. 6.
In these circumstances, the Court finds it expedient to stay the effect and operation of the proclamation and NBW issued against the Applicant and give the Applicant an opportunity to appear before the learned Magistrate on the next date i.e. 6 January 2026 and apply for cancellation of NBW and proclamation.

Let the Applicant appear before the learned Magistrate on 6 January 2026 and apply for cancellation of NBW and proclamation. 8.
In the event, the Applicant appears before the Court and file such application, the learned Magistrate may have due regard to the fact that the Applicant appeared before the Court and undertakes to regularly appear before the Court, while deciding the application for cancellation of proclamation and NBW.

In the meanwhile, the execution and operation of the proclamation and NBW shall remain stayed till 6 January 2026.

The Criminal Application stands disposed.
