Heard the learned Counsel for the parties.

The Applicant is aggrieved by an order dated 28 October 2025 whereby the application preferred by the applicant to relax/modify the condition of bail, came to be rejected.

By an order dated 19 December 2024, the applicant was enlarged on SWAROOP SHARAD PHADKE bail, subject to certain conditions. One of the conditions was to appear before the IO at Samta Nagar Police Station once in a week i.e. on every Tuesday till the filing of the charge-sheet.

Learned Counsel for the Applicant submits that the Applicant has appeared before the IO almost one year, every week and the chargesheet has yet not been filed. The condition of attendance every week is causing grave prejudice to the Applicant.

Learned APP, on the other hand, submits that the application preferred by the Applicant was rightly rejected as the applicant has antecedents and the co-accused are absconding.

Since the applicant appeared before the IO every week for almost one year, the continuation of the condition of attendance every week appears clearly onerous. The lapse of one year's time dents the object sought to be achieved by directing the Applicant to appear before the I.O. every week. The Court is, therefore, inclined to modify the condition of attendance. 7.
Hence, the following order :
ORDER
(i) The Applicant shall henceforth appear before the IO, Samta Nagar Police Station on the first Tuesday of every month between 10.00 a.m. to 2.00 p.m. for a period of six months or till the filing of the chargesheet, whichever is earlier.
(ii) Rest of the conditions of the bail remain unaltered. (iii) Criminal Application stands disposed.
