Heard the learned Counsel for the applicant.

The challenge in this application is to an order dated 12th November, 2025 passed by the learned Additional Chief Judicial Magistrate in CC NO.3612/Misc/2025, whereby the learned Magistrate had permitted the respondent - accused to travel to Kenya for the period of two months from the date of the said order.

Since the said period has expired and the learned Counsel SANTOSH SUBHASH KULKARNI Date: 2026.01.17 17:53:17 +0530 for the applicant, on instructions, submits that the respondent - accused did not travel abroad availing the said permission, there is no propriety in entertaining the application at this stage. The learned Counsel for the applicant further submitted 1/2
4-CRIAPL1628-2025.DOC that the respondent - accused is seeking return of the Passport and filing further application seeking permission to travel abroad. In the event the applicant is aggrieved by any order that may be passed by the learned Magistrate, the applicant may work out its remedies.
