Heard Mr. Priyal Sarda, learned Advocate for the Applicants. He submits that the Applicants have been falsely implicated in the present crime. He submits that the charge-sheet was filed on 10th January, 2024. He submits that there is no material, much less any evidence on record to indicate the Applicants having any motive or any intention to commit the offence charged. He submits that there is no material to show the Applicant being part of any conspiracy and that there is no recovery at the instance of the Applicants. He further submits that the presence of the Applicants at the place of incident as alleged by the prosecution itself is doubtful. 2.

Mr. P. H. Gaikwad, learned APP for the State, submits that the Applicants have committed the present crime during their period of externment. He relies on the order of externment dated 8th September, 2023 at page No.264 to 272. Rebutting the said submission Mr. Priyal Gayatri Shimpi

9-BA-4-2025.doc Sarda, submits that the offence which is alleged in the present crime is committed in the District of Kolhapur and not in the district of Solapur or Raigad.

Mr. Priyal Sarda, learned Advocate for Applicant, submits that there is a typographical error in the name of Applicant No.2 and he seeks leave to correct the name. Not objected to by Mr. P. H. Gaikwad. Leave granted. Amendment to be carried out forthwith. 4.

Mr. P. H. Gaikwad, learned APP for the State, submits that the Investigating Officer is not present today and therefore, he requests for adjournment till 11th August, 2025 so as to enable him to take instructions. Adjournment not objected to by Mr. Priyal Sarda. 5.

At the request of Mr. P. H. Gaikwad, learned APP and by consent of the parties, list this Application for further consideration on 11th August, 2025.
