By the present Application filed under section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for short "BNSS"), the Applicant is seeking regular bail in Crime No. 420 of 2024 registered at Gadhingalaj Police Station for offence punishable under Section 109, 118(1) and 3(5) of Bharatiya Nyaya Sanhita, 2023 (for short "BNS").

Applicant was arrested on 19th July, 2024 and since then Talwalkar

Mr. Matte, learned Advocate for the Applicant states that said Crime No. 420 of 2024 is registered as Sessions Case No. 26 of 2024 and is pending on the file of the learned Additional Sessions Judge, Gadhinglaj.

After having heard the matter for substantial time and upon this Court expressing its opinion of not being inclined to entertain the present Application, Mr. Matte, learned Advocate on instructions from the Applicant crave leave to withdraw the present Bail Application by seeking liberty to apply afresh before the learned Trial Court in the event of change in circumstances. Leave as prayed for is granted. In the event of any such application being filed by the Applicant, the learned Trial Court to consider the same on its own merits and in accordance with law. 6.

Criminal Bail Application No. 5 of 2025 is dismissed as withdrawn with liberty as above.
