This is an application for regular bail.

The applicant came to be arrested in Crime No. 100 of 2024 registered at Pune City Cyber Police Station, DistPune for the offences punishable under Sections 419 & 420 r/w 34 of the Indian Penal Code and Sections 3 & 4 of Maharashtra Protection of Interest of Depositors Act and Section 66(D) of the Information Technology Act. 3.
The present applicant is accused No. 2. The allegations against the applicant and other co-accused are of defrauding the complainant and other investors to the tune of Rs.1,96,16,603/-.

I have heard the learned counsel for the applicant and the learned APP for the respondent/State. 5.
The learned counsel for the applicant submits that applicant is an engineer. It is submitted that the accused No.3 who is his friend took the details of bank accounts from him of accused No.1, who his also his friend on the pretext that he wants the said details for gaming transactions. It is submitted that very small amount was deposited in the bank account of accused No.1. It is submitted that applicant is in jail for nine months and there are no criminal antecedents.

On the other hand the learned APP for State submits that amount of Rs.4,43,141/- was deposited in the bank account of accused No.1. It is submitted that considering the nature of offence, the applicant may not be released on bail.

Considering the fact that the applicant is in jail for nine months and as there are no criminal antecedents, I am inclined to release the applicant on bail. In the result, the following order is passed:
O R D E R
A] The Application is allowed.
B] The applicant be released on bail in Crime No. 100 of 2024 registered at Pune City Cyber Police Station, Dist-Pune for the offences punishable under Sections 419 & 420 r/w 34 of the Indian Penal Code and Section 66(D) of the Information Technology
Act, on furnishing P.R Bond in the sum of Rs.25,000/- (Rupees Twenty Five Thousand) with one or two sureties in the like amount.
C] The applicant shall attend the concerned police station once in a month, i.e., on first Saturday between 11:00 am to 2:00 pm, till conclusion of the trial.
