Heard Mr. Amit Icham, learned Advocate for the Applicant and Ms. Anamika Malhotra, learned APP for the State. 2.

By the present Application, Applicant is seeking bail in Crime No. 384 of 2021 registered with Yavat Police Station, Taluka Daund, District Pune for the offence punishable under Sections 302, 307 and 201 read with Section 34 of the Indian Penal Code (for short "IPC"). 3.

Ms. Anamika Malhotra, learned APP for the Respondent-State, submits that the daughter of the Applicant by name Vaishnavi alias Purva Sachin Sonawane is the eyewitness in the present crime. She, on instructions from the Investigating Officer, Yavat Police Station District Pune, submits that the prosecution shall examine Vaishnavi alias Purva Sachin Sonawane as the first witness in Sessions Case No.112 of 2021. She submits that witness summons to Vaishnavi alias Purva Sachin

Sonawane will be issued on 18th August, 2025. She, again on instructions from the Investigating Officer, makes a statement that the examination/recording of oral testimony of Vaishnavi alias Purva Sachin Sonawane in Sessions Case No. 112 of 2021 would be completed and concluded by 30th September, 2025. Prosecution shall abide by the statement made today by Ms. Anamika Malhotra. 4.

On the basis of the said statement made by Ms. Anamika Malhotra, learned APP for the State, Mr. Amit Icham, learned Advocate for the Applicant, on instructions from the Applicant, craves leave to withdraw the present Bail Application with liberty to file a fresh Bail Application before the Trial Court upon completion of the recording of the statement / oral testimony of Vaishnavi alias Purva Sachin Sonawane in Sessions Case No. 112 of 2021. Ms. Anamika Malhotra does not object to the said request made by Mr. Amit Icham. 5.

In view of the above and by accepting the statement made by Ms. Anamika Malhotra, leave is granted to the Applicant to withdraw the present Bail Application with liberty to file a fresh Bail Application before the Trial Court upon the recording of the statement / completion of examination in chief and cross-examination of Vaishnavi alias Purva Sachin Sonawane in Sessions Case No.112 of 2021. If such an Application is filed, the same shall be considered on its own merits and in accordance with law.

Mr. Amit Icham and Ms. Anamika Malhotra submit that the Applicant as well as Respondent shall co-operate with the learned Trial Court and shall not seek any unnecessary adjournment.

Mr. Amit Icham, learned Advocate for the Applicant states that copy of this order shall be placed on the file of the Sessions Case No.112 of 2021 within 10 days from today.

Criminal Bail Application No.23 of 2025 is disposed of in the above said terms.
