Heard Mr. Amit Icham, learned Advocate for the applicant and Ms. Malhotra learned APP for the State.

Mr. Icham states that co-accused Nos. 2 and 3 have been released on bail. He places reliance on page Nos. 158 and 163 of the paper book. He submits that there is inconsistencies in the statements of the eye witness in the context of her statement recorded under section 161 and 164 of the Code of Criminal Procedure, 1973.

Ms. Malhotra, learned APP for the State submits that both the statements have same evidentiary value. Mr. Icham states that statement under section 164 would prevail over statement under Talwalkar
