This is an application for regular bail.

The applicant came to be arrested in Crime No.266 of 2024 registered at Shiroli MIDC Police Station, Kolhapur for the offence punishable under Sections 109, 115(2), 189(2), 191(2), 191(3), 190, 352, 351(2), 351(3), 324(4), 155(2) of Bharatiya Nyaya Sanhita, 2023 and Section 135 of Maharashtra Police Act, 1951.

According to the prosecution, on the date of incident, which took place on 23.09.2024, on account of previous dispute, the present applicant and other co-accused assaulted the complainant Shubham Dange by sharp weapons and attempted to commit his murder.

I have heard the learned counsel for the applicant and learned A.P.P. for the Respondent-State.

The learned counsel for the applicant submits that the applicant is aged about 20 years and Second year student of B.Com.. It is submitted that there are no other criminal antecedents against the applicant. It is further submitted that there is a cross FIR in relation to the very same incident. 6.

On the other hand, the learned A.P.P. for the Respondent-State submits that the present applicant assaulted the complainant by Koyta. It is submitted that considering the nature of offence the applicant may not be released on bail. 7.

The applicant is in jail for five months. There are no other criminal antecedents against the present applicant. Considering the overall facts and circumstances, I am inclined to release the applicant on bail.

ORDER

(i) Criminal Bail Application is allowed;

(ii) The applicant is directed to be released on bail in connection with Crime No.266 of 2024 registered at Shiroli MIDC Police Station, Kolhapur for the offence punishable under Sections 109, 115(2), 189(2), 191(2), 191(3), 190, 352, 351(2), 351(3), 324(4), 155(2) of Bharatiya Nyaya Sanhita, 2023 and Section 135 of Maharashtra Police Act, 1951 on executing P.R. Bond in the sum of Rs.25,000/- with one or two sureties in the like amount;

(iii) The applicant shall attend the concerned Police Station once in a month i.e., on first Saturday between 11:00 a.m. to 1:00 p.m. till conclusion of trial; (iv) Application stands disposed of accordingly.
