The learned A.P.P. submits that in view of the invocation of Section 302 of the Indian Penal Code,1860 (for short 'IPC'), the prosecution has filed the supplementary charge-sheet. In that view of the matter, the learned counsel for the applicant seeks leave to withdraw the present application with liberty to file fresh bail application before the Sessions Court.

The bail application is disposed of as withdrawn with liberty as sought.
3.
If such bail application is filed, the Sessions Court shall decide it on its own merits.
