This is an application for regular bail.

The applicant came to be arrested in Crime No.19 of 2024 registered at Kamothe Police Station, Navi Mumbai for the offences punishable under Sections 406 and 420 of the Indian Penal Code.

According to the prosecution the complainant and witnesses Pandharinath Bergal and Sachin Waghmode, who are Jewellers, had handed over 3 Kg 80 gm pure gold to the present applicant for preparing ornaments. The allegations against the present applicant are that he misappropriated the said gold on the pretext that Directorate of Revenue Intelligence had raided his shop and took away the said gold.

The learned counsel for the applicant has drawn my attention to the complaint lodged by the complainant dated 06.11.2023. In the said complaint the complainant has stated that he had handed over 5 Kg. 887 gm. of Gold. The version of the complainant is not consistent. Apart from it, there is no documentary evidence in relation to alleged transactions. In that view of the matter, I am inclined to release the applicant on bail. In the result, the following order is passed.
O R D E R
A] Bail Application is allowed.
B] The applicant be released on bail in C.R. No.19 of 2024 registered at Kamothe Police Station, Navi Mumbai for the offences punishable under Sections 406 and 420 of the Indian Penal Code on furnishing P.R Bond in the sum of Rs.25,000/- (Rupees Twenty Five Thousand) with one or two sureties in the like amount.
C] The applicant shall attend the concerned police station twice in a month i.e., on 1st and 3rd Saturday between 11.00 a.m. to 2.00 p.m. till conclusion of the trial. D] The applicant shall regularly attend the dates before the trial Court.
