This is an application for regular bail.

The applicant came to be arrested in Crime No. 477 of 2024 registered at Ambad Police Station, Dist- Nashik for the offences punishable under Sections 305(a), 331(3)

(4) & 62 of the Bhartiya Nyaya Sanhita, 2023. 3.

According to the prosecution, in the intervening night of 18.07.2024 and 19.07.2024 the applicant with a view to commit theft entered into the strong room of the Indian Bank at Ambad Nashik and attempted to cut the lockers with the help of electric cutter.

The learned counsel for the applicant submits that

the applicant has nothing to do with the alleged crime. It is submitted that there is no incriminating material against the present applicant to connect him with the alleged crime.

On the other hand, the learned APP for the respondent/State submits that the applicant is involved in six more crimes of similar nature. It is submitted that considering the nature of crime the applicant may not be released on bail.

I have perused the charge-sheet and prima-facie there appears to substance in the submission of the learned counsel for the applicant. As regards criminal antecedents the learned counsel for the applicant submits that after the arrest of the applicant in the present crime, he is taken into custody in other crimes. It is submitted that applicant has been released on bail in four crimes as in the said crimes also there was no incriminating material against the applicant.

Considering the overall facts and circumstances of the case, I am inclined to release the applicant on bail. In the result, the following order is passed:

O R D E R

A] The Application is allowed.

B] The applicant be released on bail in Crime No. 477 of 2024 registered at Ambad Police Station, Dist- Nashik for the offences punishable under Sections 305(a), 331(3)

(4) & 62 of the Bhartiya Nyaya Sanhita, 2023, on furnishing P.R Bond in the sum of Rs.15,000/- (Rupees Fifteen Five Thousand) with one surety in the like amount.

C] The applicant shall attend the concerned police station once in a month, i.e., on first Saturday between 11:00 am to 2:00 pm, till conclusion of the trial.

Application stands disposed of accordingly.
