Applicant seeks bail in Crime No. 598 of 2023, registered with Vishrambaug Police Station, Dist. Sangali for the offences punishable under Sections 32, 307, 323, 143, 148, 149, 109, 37(1), 37(3) and 135 of Indian Penal Code.

Prosecution case in short is that informant is the brother of deceased Vinod Ingle. He used to protect the women involved in the prostitution business. The applicant and other co-accused are criminals. Applicant was used to demand Rs. 25,000/- per month for entering into Gokul Nagar where the deceased was plying rickshaw.
{2} However, the deceased had declined to pay any amount to him. In past, injured Hanmant Gollar was having love affair with XYZ who was involved in the prostitution and residing at Gokul Nagar. After their relation was broken up, applicant started residing in the house of XYZ. However, applicant suspected that XYZ was again in contact with Hanmant Gollar. On that count, their was dispute between applicant an XYZ. Applicant was having grudge against the deceased Vinod as he was thinking that deceased Vinod was instrumental in bringing Hanmant Gollar and XYZ together.

Heard the learned advocate for applicant and learned APP for the State. Perused the record.

Learned advocate for applicant prayed for bail by arguing on merits as well as on the ground of parity as Accused No. 8- Mudkya alias Krushna Kutnappa Kamble, who was allegedly assaulted the deceased with knife and caused stab injury to deceased is released on bail by the Trial Court vide order dated 11.10.2024. He submits that out of 8 accused named in the FIR, 7 are released on bail. 5.
Without going into the merits of matter, since co-accused Mudkya alias Krushna Kutnappa Kamble who has caused fatal injuries to the deceased is released on bail, applicant is also entitled to be
{3} released on bail on the ground of parity.

Applicant is arrested on 10.12.2023. Though charge sheet is filed in the present crime, charge is not yet framed. Trial is not likely to conclude in near future.

In the result, application is allowed.

Applicant- Lakhan Pandit Isarde be released on bail in Crime No. 598 of 2023, registered with Vishrambaug Police Station, Dist. Sangali for the offences punishable under Sections 32, 307, 323, 143, 148, 149, 109, 37(1), 37(3) and 135 of Indian Penal Code, on executing Personal Bond of Rs. 50,000/- with one surety in the like amount.

He shall not tamper with prosecution evidence and also shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him/her from disclosing such facts to the Court or the Investigating officer.

He shall attend the court proceeding on given dates of hearing punctually. On his failure to attend the court proceeding on two consecutive dates, the prosecution will be at liberty to apply for
{4} cancellation of bail.

He shall attend the concerned police station once in a month till the conclusion of trial. He shall not enter the vicinity of informant, injured and prosecution witnesses till the conclusion of trial. 12.
He shall not commit like offence while on bail. 13.
He shall submit his current and permanent address proof and also shall furnish the addresses of his two close relatives and shall not change the address without previous intimation to the Court and the investigating officer.
