Heard Mr. Faria, learned Advocate for Applicant and Ms. Yadav, learned APP for Respondent.

Applicant is senior citizen and facing the medical ailment as stated in praecipe dated 07.05.2025.

The Chief Medical Officer of Aadharwadi Jail, Kalyan is directed to make an appropriate report about medical condition and status / treatment of Applicant to enable the Court to consider his case for out of turn hearing due to his medical condition. 4.

Mr. Faria informs the Court that condition of Applicant is precarious and he is regularly required to be treated. He would persuade the Court to consider one fact namely that Applicant is indicted in an offence punishable under Section 402 of the Indian

909.BA.126.2025.doc Penal Code, 1860 and accused of cheating of Rs.8,00,000/- but he has already suffered incarceration of 2 years, 8 months and 15 days. 5.

Mr. Faria would also persuade the Court to consider another facet namely that principal Accused is already enlarged on bail. Prima facie on the above facts and considering advanced age of Applicant and his incarceration in prison pending trial, I am of the opinion that Applicant's case can be considered.

Ms. Yadav would persuade the Court to allow her to take instructions and apprise the Court.

Stand over to 09th May, 2025 for further hearing. To be placed on the 'Supplementary Board'.
