By this application under Section 483 of the Bhartiya Nagrik Suraksha Sanhita, 2023 (for short, B.N.S.S. Act'), the applicant is seeking bail in connection with Crime No.0222/2025 registered with the nonapplicant police Station for offences punishable under Sections 109, 118(2) and 352 of the B.N.S.

The prosecution story in nutshell is that, on 23-03-2025 at about 12.30 pm injured-informant Kalyani came to be admitted at the Rural Hospital, Deoli with an injury. After doing the primary suturing, she was referred to the General Hospital, Wardha for further treatment. The police recorded the statement of injured Sau. Kalyani in the course of which she has stated that her husband Shubham fought with her and left home. As he did not return for two days the informant went to the house of her in-laws, however her husband attacked her there and abused her due to which she went and sat on the stairs of the house of her relative situated nearby. Thereafter, informant's husband went inside his house
2 ba 136.26.odt and brought a knife after which he assaulted her causing grievous injuries. Based on these allegations, FIR came to be lodged. 4.
The applicant is the husband of the informant victim. The offence is registered under Sections 109, 118(2) and 352 of the BNS. The learned Counsel appearing for the applicant submits that the parties have settled their dispute and that applicant and the informant want to reside together. The victim is present in the Court. The learned Counsel appearing for the victim has also filed a Pursis, which is taken on record and marked as 'X' for identification, stating therein that the informant and the applicant are husband and wife, they have amicably resolved their dispute and have settled the matter among themselves and she is not having any objection to grant bail to the applicant. Considering this fact, I am inclined to grant bail to the applicant. Hence, the following order. (i) Criminal application is allowed and disposed of.
(ii) The applicant/accused be released on regular bail in Crime No.0222/2025 registered with Police Station, Deoli, Dist.Wardha, for the offences punishable under Sections 109, 118(2), 352 of the B.N.S. on his executing P.R. Bond of Rs.25,000/- (Rupees Twenty Five thousand only) with one solvent surety in like amount.
(iii) The accused shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case, as also shall not tamper with the evidence. (iv) The accused shall provide his residential address and cell number to the concerned Police Station and shall not change

(v) The applicant/accused shall attend each and every date of trial regularly. If he fails to attend the trial for two consecutive dates or fails to comply with the aforesaid conditions, his default would entail the State to ask for cancellation of bail. (M.M. Nerlikar, J.)
