In the present Bail Application, this Court passed following order on 22nd September 2025, which reads thus; "1.

The Applicant has sought his release on bail for the offences connected with C.R.No.607 of 2024 dated 23rd August 2024 registered with the Tulinj Police Station, Nallasopara (East) for the offences punishable under Sections 64, 70(2) of the Bharatiya Nyaya Sanhita ('BNS'), 2023 and Sections 4, 6 and 8 of the Protection of Children From Sexual Offences Act, ('POCSO') 2012.

It is alleged by Ms Kusum Pandey, representing the Applicant that the Applicant was arrested on 23rd August 2024 and till date, charges are not framed.

Ms Anuja Gotad, learned APP representing the State, on instructions, submits that there are only 10 witnesses, which the prosecution intends to examine.

In these circumstances, the Trial Court is requested to frame charges within a period of four weeks from the date on which this order is presented before the Court and within four weeks thereafter, to take deposition of the victim.

Stand over to 24th November 2025."

Today, I am informed by Ms. Kusum Pandey, learned counsel appearing for the Applicant, that neither the charges have been framed nor the Applicant is produced before the Trial Court.

In these circumstances, the Trial Court is directed to submit a report pertaining to the status of the trial along with the reasons as to why the charges are not framed, till date, within a period of 8 days from today.

Stand over to 18th December 2025.
