This Court passed following order on 30th January 2026:- 1.

Despite the order dated 24th November 2025, directed to submit a report pertaining to the status of the trial and as to why the charges were not framed pursuant to the order dated 22nd September 2025, the said report has not been submitted by the said Court. Today, despite the direction vide the order dated 22nd September 2025 to

Shivgan 23-BA-161-2025.doc record the deposition of the victim within four months after the charges were framed, I am informed that, even till date, the deposition of the victim has not been recorded. 2.

The Registrar (Judicial-I) is requested to call for a report from the Trial Court concerned as to why the report was not sent as per the order dated 24th November 2025 and in what circumstances the deposition of the victim is not recorded pursuant to the orders of this Court. 3.

Stand over to 23rd February 2026.

Pursuant to the aforesaid order, the learned District Judge-3 and Additional Sessions Judge, Thane, has submitted a report indicating that the charges have been framed and the Accused is being produced before the Court through Video Conferencing.

Ms. Kusum Pande, learned counsel appearing for the Applicant, submits that the matter was listed before the Trial today and that even today, the prosecution has failed to examine the witness.

Ms. Anuja Gotad, learned APP representing the State in the matter, to take instructions as to why the statement of the Victim was not recorded despite the Victim being present before the Trial Court today.
