This is an application for regular bail.

The applicant came to be arrested in Crime No. 578 of 2024 registered at Panchawati Police Station, District : Nashik, for the offences punishable under Sections 3, 4 & 5 of the Immoral Traffic (Prevention) Act, 1956.

The allegations against the present applicant are of running brothel in the lodge, where he was working as a Manager.

The learned counsel for the applicant submits that the applicant is in jail for four months and there are no other criminal antecedents.

On the other hand, the learned A.P.P. for the Respondent-State submits that the present applicant has induced the victims to indulge in prostitution activity. It is submitted that, considering the nature of offence, the applicant may not be released on bail.

There are no minor victims. The applicant is in jail for about four months. There are no other criminal antecedents against the applicant. In that view of the matter, I am inclined to release the applicant on bail on certain conditions.

ORDER

(i) Criminal Bail Application is allowed;

(ii) The applicant is directed to be released on bail in connection with Crime No. 578 of 2024 registered at Panchawati Police Station, District : Nashik, for the offences punishable under Sections 3, 4 & 5 of the Immoral Traffic (Prevention) Act, 1956 on executing P.R. Bond in the sum of Rs.25,000/- with one or two sureties in the like amount;

(iii) The trial Court shall release the applicant on cash bail of Rs.25,000/- and the four weeks time is granted to furnish the surety;

(iv) The applicant shall deposit the amount of Rs.50,000/- in the following NGO account :

SBIN0020800 (v) The trial Court shall not issue release warrant, unless the said amount of Rs.50,000/- is deposited. (vi) The applicant shall not commit any other crime of similar nature in future.
