When this Court is not inclined to grant bail, the learned counsel appearing for the applicant, on instructions, seeks withdrawal of the present application, with liberty to file a fresh bail application, in case, the trial is not concluded within three months.

In this matter, this Court, has already permitted the applicant to withdraw the application by an order dated 11/02/2025 passed in Criminal Application [B.A] No.46/2025, however, granted liberty to apply afresh for bail, if there is no substantial progress in the trial within six months. Accordingly, the present application was filed. It appears that, the trial has progressed, and
17-Cr.BA-239-2026 approximately six witnesses are examined by the prosecution.

The learned A.P.P. submits that, hardly four to five witnesses remain to be examined by the prosecution, and the trial would be concluded within three months. Considering the above factual background, permission is granted to withdraw the application, with liberty to file a fresh before this Court, in case, the trial is not concluded within three months.

The trial Court is requested to conclude the trial within three months, as the applicant is in jail since 07/05/2024. With these observations, the application is disposed of as withdrawn, with liberty as prayed for.
