Heard Mr. Kankaria, learned Advocate for Applicant and Mr. Ganpathy, learned APP for Respondent - State. 2.

This is an Application under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 seeking Regular Bail in connection with C.R.No.7 of 2024 registered with Anti-Corruption Bureau, Mumbai for the offences punishable under Sections 7, 12, 13(1)(a) read with Section 13(2) of the Prevention of Corruption Act, 1988 and Sections 403, 409, 420, 465, 467, 468, 471, 477(A) and 109 of the Indian Penal Code, 1860.

Applicant before me is arraigned as Accused No.2 and he is incarceration since 28.06.2024.

Mr. Kankaria, learned Advocate for Applicant would submit that role of the Applicant is so restricted that by no stretch of imagination, it can be alleged that he was involved in the crime. He would fairly submit that Applicant is a real estate broker who would carry out registration work of the transactions of the shops / offices where the other accused carried out their business. He would submit that Applicant has not received a single penny in his bank account and there is no whisper of the same in the charge-sheet as well. 5.

He would therefore urge the Court to consider his Bail Application since 2 out of the 6 Accused have already enlarged on bail one of enlarged on bail by the Division Bench of this Court and other by this Court.

In view of the above, learned APP is directed to take appropriate instructions from the Investigating Officer. Concerned Investigating Officer is directed to present before this Court on the next adjourned Court.
