By this application, the Applicant is seeking regular bail in C.R.No. 148 of 2024 registered with Harsul Police Station, District Nashik for the offence punishable under Sections 108, 85, 352, 351(3) and 3(5) of Bhartiya Nyaya Sanhita, 2023. 2.

The Applicant is husband of the deceased Yogita. It is alleged that the deceased has committed suicide due to mental and physical harassment by the Applicant.

It is contention of learned counsel for the Applicant that Applicant is behind bars for more than 1 year and 6 months. There is no progress in the trial. It may take time to conclude the trial hence, requested to allow the application.

It is contention of learned APP and learned counsel for Respondent No.2 that Applicant had love affair with the other lady, on that ground, the Applicant used to harass the deceased. Due to continuous mental and physical harassment by the Applicant, the deceased has committed suicide. If Applicant is released on bail, he may abscond or threaten prosecution witnesses. Hence, requested to reject the application.

I have heard all learned counsel. Perused FIR and documents produced on record. The Applicant is behind bar for more than 1 year and 6 months. There is no progress in the trial. No suicide note is written by the deceased. To prove the allegations against the Applicant, trial is required. The Applicant has no antecedents. Considering these facts, I pass following order.

ORDER

i.

The Applicant is released on bail in C.R.No. 148 of 2024

registered with Harsul Police Station, District Nashik, on executing P.R.Bond of Rs. 30,000/- on furnishing one or two sureties in the like amount.

ii.

The Applicant shall attend the concerned police station as and when required.

iii.

The Applicant shall not tamper with the evidence or attempt to influence or contact the complainant, witnesses or any person concerned with the case.

iv.

The Trial Court shall not be influenced by the observations made in this order and shall decide the matter on its own merits and in accordance with law.

6.

The Bail Application is allowed in the aforesaid terms and is accordingly disposed of.

7.

All concerned to act on the authenticated copy of this order.
