Heard Mr. Kulkarni, learned APP for State.

Applicant is indicted in offences punishable under the provisions of IPC and POCSO Act. It is seen that Applicant is incarcerated since 2019 and I propose to take up this Application for hearing on the next adjourned date after completing the prescribed procedure. 3.

On perusing the Application, it is seen that Applicant has not impleaded the victim as a party Respondent. In that view of the matter, Advocate for Applicant is directed to implead the victim as Respondent No. 2 in the present Application. Amendment is permitted to be carried out within a period of one week from today. Reverification stands dispensed with.

Issue notice to Respondents returnable on 03.03.2024. Humdast permitted.

In addition to service of notice through Court, learned Advocate for Applicant shall serve one extra set of papers of the present Application on the concerned Investigating Officer (IO) directly. Learned APP shall inform the IO to ensure that a responsible lady police officer is deputed and consent of Respondent No. 2 / legal guardian is accordingly obtained for legal representation if she desires through the Legal Aid and apprise the Court on the next date so that this Court can take further steps to appoint Advocate to represent and espouse the cause of Respondent No. 2.

Learned Advocate for Applicant is not present today. He shall take cognizance of this order and comply with the same. 7.
