Present Applicant is arrested by the prosecution for the offences punishable under Sections 8(c), 20b(ii)(c), 28, 29 and 30 read with 35 of the Narcotics Drugs and Psychotropic Substances Act, 1985 (for short "NDPS Act") being in possession of the alleged contraband namely ganja weighed 800 grams which is admittedly small quantity according to the learned Advocate for Applicant. Rigours of Section 37 of the NDPS Act would not apply in the facts of the present case.

Learned Advocate for the Applicant would inform the Court that Applicant was already enlarged on bail but because he did not attend the Trial Court, thereafter Trial Court issued an arrest warrant against him and he has once again been arrested. Hence, Applicant has filed a fresh Bail Application. He would submit that previous Bail Application of the Applicant was allowed by the Trial Court enlarging him on bail.

Considering the aforesaid facts and the request made by the learned Advocate for the Applicant, present Application shall be heard and decided on the next adjourned date which shall be noted by the prosecution.
