Heard Mr. Gogavle, learned Advocate for Applicant and Mr. Karmakar, learned APP for Respondent - State. 2.

Mr.. Gogavle would draw my attention to the seizure panchanama appended at page No. 42 of the Application and would contend that search and seizure operation of the alleged contraband has been carried out by the Asst. Police Inspector Mr. Kadam who is not a gazetted officer. He has placed on record Government Resolution dated 26.02.2024 wherein according to him it is stated that Asst. Police Inspector is not a gazetted officer. Copy of the said Government Resolution has been handed to the learned APP. 3.

Learned APP shall take appropriate instructions in the matter and according appraise the Court on the next adjourned date.
