Applicant - accused has filed the present Application for regular bail in connection with Crime No. 176 of 2021 registered with Dombivali Police Station on 30.06.2021 for the offence punishable under Sections 307, 323 and 504 of the Indian Penal Code, 1860. 3.

Applicant before me is 20 years of age. It is informed by learned Advocate for Applicant that Applicant is having 3 antecedents. Applicant is in incarceration for the past 3 years and 7 months pursuant to the happening of the incident.

Incident in question occurred at the Petrol Pump when the Injured victim dashed his two wheeler into the Applicant which enraged the Applicant leading to scuffle and skirmish between the

7_BA_507_2025.docx them, which according to the learned Advocate for the Applicant occurred on the spur of the moment because of the dash given to the Applicant. The altercation escalated to such an incident that Applicant who was carrying a knife with him used it to slash the victim which resulted into causing 4 injuries.

According to the Advocate for Applicant all 4 injuries suffered by victim are not classified at all in the medical certificate which is placed on record.

Learned APP is directed to take instructions and inform the Court about the nature of injuries suffered by the victim. Considering the long incarceration suffered by the Applicant, I propose to take up this matter for deciding on the next adjourned date. 7.

Learned Advocate for Applicant would submit that 2 years prior directions were given to frame charge. Save and except framing of charge trial has not commenced.
