This is an application for regular bail.

The applicant came to be arrested in Crime No.204 of 2024 registered at Ichalkaranji Police Station, Kolhapur for the offences punishable under Sections 326, 504, 143, 147 of the Indian Penal Code.

According to the prosecution, on the date of incident, which took place on 21.4.2024, the present applicant and other coaccused, on account of previous enmity, assaulted the injured by stick and stone and caused him grievous injuries. 4.

I have heard the learned counsel for the applicant and the learned APP for the respondent - State.

Learned counsel for the applicant submits that the offences are triable by the Magistrate. It is submitted that the applicant is in jail for about 10 months and the trial has not commenced. It is submitted that there are no other criminal antecedents. 6.

On the other hand, learned APP for the respondent/State submits that the applicant has assaulted the injured by stone. It is submitted that considering the nature of crime, the applicant may not be released on bail.

Considering the fact that the applicant is in jail for 10 months and as there are no other criminal antecedents, I am inclined to release the applicant on bail. In the result, the following order is passed.

O R D E R

A] The Application is allowed.

B] The applicant be released on bail in C.R. No. 204 of 2024 registered at Ichalkaranji Police Station, Kolhapur for the offences punishable under Sections 326, 504, 143, 147 of the Indian Penal Code on furnishing P.R Bond in the sum of Rs.25,000/- (Rupees Twenty Five Thousand) with one or two sureties in the like amount.
