Heard Mr. Prandarwala, learned Advocate for Applicant and Mr. Haldankar, learned APP for Respondent - State. 2.

Applicant stands indicted for offences punishable under Sections 307 and 504 of IPC. He has been in incarceration for a period of 2 years 2 months and 10 days as of today.

Mr. Prandarwala would submit that Applicant is apprehended and arrested solely on the basis of circumstantial evidence and he has no direct role whatsoever to play in the crime. He would submit that Applicant was not present at the incident spot when the crime occurred. He would submit that the Applicant is a fruit seller by profession and has deep roots in society. He would submit that Applicant is the sole witness in the present crime and due the

57. BA-559-25.docx precursor incident of theft occurred two days probably leading to the present crime which is borne out from the record. 4.

In view of the above submissions made by Mr. Prandarwala, learned APP shall ascertain the precise role of the Applicant from the chargesheet and also ascertain veracity of the submissions made by learned Advocate for Applicant to enable this Court to consider the present Bail Application.
