Applicant is incarcerated for more than 4 years in offences punishable under Section 302 read with 34 of the Indian Penal Code, 1860 and Sections 4 and 25 of the Arms Act.

Ms. Gaikwad, learned Advocate for the Applicant would inform the Court that the incident occurred on the spur of the moment when the victim was teased by the Applicant on the name of his father in front of the witnesses and it happened in a fit of rage. She would fairly inform the Court that there are two eye witnesses to the incident who have recorded their statements. However she has persuaded the

89.BA.562.25.doc Court to consider the Applicant's case for grant of bail on the ground of long incarceration and especially when charges are also not framed till date and the fact that it was not a premeditated incident with any motive. She would make one additional submission about the age of Applicant. She would submit that Applicant was a young offender of 20 years when the incident occurred and therefore endeavour be made by the Court to consider his Bail Application to save him from further incarceration.

Prosecution shall take appropriate instructions from the concerned Investigating Officer of the aforesaid submissions made by the learned Advocate for Applicant and apprise the Court on the next adjourned date.

Stand over to 06th March, 2025. To be placed on the 'Supplementary Board'.
