Heard Mr. Advait, learned Advocate for Applicant and Ms. Bajoria, learned APP for Respondent - State.

Applicant stands indicted for offences punishable under IPC. He has been in incarceration for more than 3 years. 3.

One of the principal submissions made by Mr. Advait is on the ground of parity. He would submit that there are 3 accused in the crime out of which accused No. 2 has inflicted a blow of iron rod on the injured victim and he has been enlarged on bail. Said order is appended at page Nos. 164-171 of the Application. He would submit that role attributed to the present Applicant is of he having inflicted a knife blow in the abdomen of the injured victim and also having inflicted a blow with paver block on the back of his head. He would

61. BA-599-25.docx fairly submit that Applicant has antecedents but equally accused No. 2 who has been enlarged on bail also had 13 antecedents despite which he has been released on bail. He would therefore persuade the Court to consider long incarceration of the Applicant for more than 3 years and allow the present Application.

Learned APP shall ascertain the precise role of the Applicant and ascertain the veracity of the submissions made by Mr. Advait and apprise the Court accordingly on the next adjourned date. 5.
