Heard Mr. Vilas Bambarde, learned Advocate for the Applicant. He submits that the Applicant is suffering from epilepsy and as such this Court had called for a medical report from the jail authorities.

Today, Dr. Ashvini Takalkar, learned A.P.P. for the State/Respondent tenders a letter dated 17th May 2025 issued by the Superintendent of Taloja Central Prison, Navi Mumbai alongwith the prisoner's medical report. Letter dated 17th May 2025 and the prisoner's medical report (total 5 pages) are taken on record and marked as "X Colly." for identification. 3.

Paragraph no. 15 of the said report reads as follows :- Gitalaxmi

15-BA-608-2025.doc "15) Present Health Status :- For his above medical ailments he was referred to Sir JJ Group of Hospital, Mumbai on dated 25.03.2025. Prisoner treated by Medicine Department. As per medical papers of Sir JJ Hospital patient having seizere disorder because of which he is taking anti-epileptic drugs regularly. (Medical papers attached herewith).

His MRI Brain & EEG is scheduled on 20.05.2025. Previously his MRI was not done due to unavailability of fitness form experts.

Prisoner will refer to Sir JJ Group of Hospital, Mumbai on 20.05.2025 for his MRI as per availability of police escorts." 4.

Dr. Ashvini Takalkar, learned A.P.P. for the State/Respondent also tenders a letter dated 10th August 2025 addressed by the Police Sub-Inspector to the office of Public Prosecutor. Same is taken on record and marked as "Y" for identification. The said letter inter alia records the Applicant having 5 criminal antecedents by way of Criminal Cases and 13 Non-cognizable Cases.

Mr. Vilas Bambarde, learned Advocate for the Applicant seeks time to take instructions and also to find whether the family members of Applicant are ready to take responsibility of the Applicant.

At the request of Mr. Vilas Bambarde, learned Advocate for the Applicant and by consent of the parties, list the matter on 20th August 2025.
