Heard Mr. Nizam, learned Advocate for Applicant and Mr. Haldankar, learned APP for Respondents - State. 2.

By order dated 14.02.2025, Applicant was directed to serve copy of the Application on Respondents. Mr. Nizam would inform the Court that Applicant has complied with the said order. Prima facie it appears that the said order ought not to have been passed by the Court when the prosecutrix(s) / victim (s) has/have not been made Respondent(s) to the present Application through the concerned Police Station. The cause title of the Application shows that Respondent Nos. 2 an 3 are Senior Inspector of NRI Sagari Police Station and Senior Inspector Turbhe Police Station.

Considering the indictment of the Applicant for the offences punishable under IPC, POCSO Act & Juvenile Justice Act, Applicant is

107. BA-628-25.docx directed to implead the prosecutrix(s) / victim(s) without disclosing their names through the concerned Police Station(s). Let the amendment be carried on or before 15.04.2025. Re-verification stands dispensed with.

Once the amendment is carried out, issue notice to Respondents returnable on 21.04.2025. Humdast permitted. Learned APP waives service for Respondent No. 1.

In addition to service of notice through Court, learned Advocate for Applicant shall serve extra set of papers of the present Application on the concerned Investigating Officer(s) [IO(s)] directly. Learned APP shall inform the IO(s) to ensure that a responsible lady police officer is deputed and consent of newly added Respondent(s) / legal guardian(s) is accordingly obtained for legal representation if they desire Legal Aid and apprise the Court on the next date so that this Court can take further steps to appoint Advocate to represent and espouse the cause of newly added Respondent(s). 6.

Let the aforesaid exercise be carried out within a period of two weeks from today.
