This is an application for regular bail.

The applicant came to be arrested in Crime No. 271 of 2021 registered at Sangvi Police Station, Pimpri-Chinchwad, District : Pune for the offences punishable under Sections 143, 147, 149, 364-A, 365, 386, 452, 506(2) of the Indian Penal Code r/w Section 39 of the Maharashtra Money-Lending (Regulation) Act, 2014 r/w Section 7 of the Criminal Law Amendment Act, 1983.

The allegations against the applicant and other co-accused are of abducting the complainant and compelling him to execute certain documents for alleged non return of money borrowed by him from the present applicant and brother of the applicant, who is also co-accused in the present crime.

I have heard the learned counsel for the applicant, learned A.P.P. for the Respondent-State and the learned counsel for the Complainant/First Informant.

The bail is inter alia sought on the ground of parity. In support of the said ground, the learned counsel for the applicant has relied upon the order passed by the Hon'ble Supreme Court dated 16.12.2024 in Criminal Appeal No.5371
of 2024. By the said order, the Hon'ble Supreme Court has released the co-accused brother of the applicant on bail. 6.
On the other hand, the learned A.P.P. for the Respondent-State and learned counsel for the Complainant/First Informant submits that considering the nature of crime, the applicant may not be released on bail. 7.
I have perused the First Information Report. The main incident is dated 22.11.2019 and the allegations in respect of the said incident against the applicant and his brother appears to be identical. Apart from it, the applicant is in jail for about three years and five months and the trial has not commenced. In view of the order passed by the Hon'ble Supreme Court, I am inclined to release the applicant on bail on certain conditions.
ORDER
(i) Criminal Bail Application is allowed;
(ii) The applicant is directed to be released on bail in connection with Crime No. 271 of 2021 registered at Sangvi Police Station, Pimpri-Chinchwad, District : Pune for the offences punishable under Sections 143, 147, 149, 364-A, 365, 386, 452, 506(2) of the Indian Penal
Code r/w Section 39 of the Maharashtra Money-Lending (Regulation) Act, 2014 r/w Section 7 of the Criminal Law Amendment Act, 1983 on executing P.R. Bond in the sum of Rs.25,000/- with one or two sureties in the like amount;
(iii) The applicant shall not enter into the limits of Pune and Raigad Districts except to attend the dates before the trial Court.
(iv) Application stands disposed of accordingly.
(v) In view of disposal of Bail Application, Interim Application does not survive and stands disposed of accordingly.
