Applicant is 65 years old under-trial person indicted in offences punishable under Narcotics and Psychotropic Substances Act, 1985 (for short 'NDPS Act') having been incarcerated in jail from 20.08.2023.

Mr. Lalla has place praecipe dated 15.04.2025 on record appended to which is the detailed medical examination report of Sir J. J. Group of Hospital, Mumbai which is endorsed by Chief Medical Officer, Taloja Central Prison, inter alia, stating that Applicant is diagnosed with and suffering from severe complications and STD

Mr. Pethe, learned APP appears for Respondent in the present case. Copy of praecipe alongwith report is handed over to Mr. Pethe, learned APP. He shall obtain the concurrence of concerned Chief Medical Officer of Taloja Central Prison on the veracity of claim of Applicant and accordingly inform the Court. 5.
Prima facie, Court is of the opinion that if what is stated in the report is true then it would be a fit case for considering the case of Applicant for grant of Application immediately on merits. 6.
