The Application is for grant of bail.

Heard learned Counsel for the Applicant to some extent. Perused the report of the District Judge-2 and Additional Sessions Judge, Nagpur which clearly shows that it was not the prosecution on behalf of which the trial is delayed but after sufficient efforts by the prosecution it is the defence Counsel who is not cooperating with the Trial Court and not proceeding with the trial, and therefore, the trial has not proceeded, and therefore, I have shown my disinclination to grant bail to consider the ground for delay in trial. The learned Trial Court shall proceed with the trial expeditiously without considering the adjournment application unless there are exceptional circumstances.

The learned Counsel for the Applicant asked for liberty, however, considering that it is the non-cooperation of the defence Counsel, due to which the trial is not progressed, and therefore, I am not inclined to grant any liberty to the Applicant to file any Application.

Pending application/s, if any, shall stand disposed of accordingly.
