Heard Mr. Jadhav, learned Advocate for Applicant and Mr. Pethe, learned APP for Respondent - State.

Mr. Jadhav would submit that Applicant is incarcerated for more than 4 years and 6 months in offences punishable under Sections 302, 326 and 504 read with 34 of the Indian Penal Code, 1860. 4.

He would submit that there are two accused in the Application and the case of the prosecution is based entirely on circumstantial evidence. He would submit that co-accused in the crime has already been granted bail. He would persuade the Court to consider that role of the Applicant is identical to that of the co-accused if at all the prosecution case is to be considered and in view of the

31.BA.645.25.doc uncertainty of the trial commencing or being completed in the near foreseeable future, the Bail Application be considered and allowed. 5.

Mr. Pethe, learned APP appears for the Prosecution. He is directed to take cognizance of the aforesaid submissions and inform the precise role of the Applicant in the crime to the Court on the next adjourned date. Considering the long incarceration of Applicant for more than 4 years and 6 months as the date of his arrest is 03.08.2020, the present Application shall be taken up for hearing and decided on the next adjourned date which may be noted by the prosecution. 6.
