Heard Ms. Mahajan, learned Advocate for Applicant and Ms. Bajoria, learned APP for Respondent - State. 3.

Applicant is a developer / Builder. Learned advocate for Applicant would inform the Court that crime has been lodged by the First Informant in view of an accident met by the niece of the First Informant of having fallen down from 4th Floor of the building. She would submit that the building is seven year old. She would inform the Court that First Informant's sister along with her daughter was attending a Satya Narayan Pooja on the 3rd Floor of the building when daughter of his sister went up to the 4th Floor and had a fatal fall due

to certain safety issues in the building. Incident incidentally led to death of the child. She would persuade the Court to consider the fact that the developer had constructed the said building seven years ago after which the same was handed over to the flat purchasers. Facts of the present case show that safety issue stated is that there was no railing on the 4th floor because of which the victim child suffered the fatal fall from there.

Learned Advocate for Applicant would place on record Wedding Invitation Card of one of the close relative of the Applicant and persuade the Court to consider his interim release on bail on 7th March, 2025 to allow him to attend the marriage ceremony of the relative in Shahad, Murbad District Thane.

4.1.

She would submit that she has taken instructions from Applicant's relatives for submitting that they are agreeable to payment of escort charges also for one day. If that be the case there can be no impediment in allowing the Applicant interim bail to attend the marriage ceremony along with escort.

4.2.

However, since the request is made today the copy of the Invitation Card is handed over to the Investigating Officer who is present in the Court. According to the request made by the learned Prosecutor, the Investigating Officer be allowed to verify the same. He is

directed to verify and apprise the Court through the APP so that appropriate order can be passed to release the Applicant on interim bail to attend the marriage ceremony on 7th March, 2025. 5.

In view of the above, appropriate order for releasing the Applicant on interim bail as prayed for by the Applicant shall be passed tomorrow.
