The Applicant came to be arrested on 05.01.2025, in connection with Crime No. 12/2025 registered with Police Station M.I.D.C., Nagpur City for the offences punishable under Sections 75, 76 of the Bhartiya Nyaya Sanhita, 2023 and Sections 10 & 12 of the Protection of Children from Sexual Offences Act.

The crime is registered on the basis of the report lodged by father of the Victim aged about 10 years, on an allegation that when the Victim was in a bath room the present Applicant entered the bath room and outraged her modesty by touching to her private parts. On the basis of the said report Police have registered the crime against the present Applicant.

Heard learned Counsel for the Applicant who

2 16.BA.675-2025.odt submitted that, baseless allegations are levelled against the present Applicant who is the landlord of the house, wherein the Victim and her father are residing. He submitted that, now the investigation is already completed charge-sheet is already filed, considering the nature of offence further incarceration of the present Applicant is not required. In view of that, the Application deserves to the allowed. 4.

Learned APP, strongly opposed the said application and submitted that, considering the nature of the allegations that the Applicant has not only subjected for outraging her modesty but he has also tried to disrobe her. In view of that, the Application deserves to be rejected. 5.

On hearing both the sides and on perusal of the investigation papers, as far as the allegations are concerned which are substantiated by the witnesses to whom she has immediately disclosed the said incident. However, considering now the investigation is already completed charge-sheet is already filed, further incarceration is not required, and therefore, the Application deserves to be allowed by imposing certain conditions. Accordingly, I proceed to pass the following order.

O R D E R

i.

The Application is allowed.

The Applicant - Sachin Narayan Larokar in connection with Crime No.12/2025 registered with Police Station M.I.D.C., Nagpur City for the offences punishable under Sections 75, 76 of the Bhartiya Nyaya Sanhita, 2023 and Sections 10 & 12 of the Protection of Children from Sexual Offences Act, be released on bail, on executing P.R. Bond in the sum of Rs.25,000/- with one solvent surety in the like amount.

iii.

The Applicant shall not enter into the jurisdiction of M.I.D.C. Police Station, Hingna till culmination of the trial.

iv.

The Applicant shall furnish the detail address where he is intending to reside after he is released on bail.

v.

The Applicant shall not induce, threat or promise any witnesses who are acquainted with the facts of the case either personally or by way of electronic media.

vi.

The Applicant shall attend the proceedings before the Special Court without seeking any exemption unless there are exceptional circumstances.

6.

Pending application/s, if any, shall stand disposed of accordingly.
