Heard Mr. Siddharth A. Mehta, learned Advocate for the Applicant and Ms. Veera Shinde, learned APP for the State. 2.

By the present application under Section 483 of Bharatiya Nagarik Suraksha Sanhita, 2023, Applicant is seeking bail in connection with C. R. No.09 of 2024 registered with Khadak Police Station, Pune, for the offences punishable under Sections 307, 336, 504, 323, read with 34 of the IPC. Said crime is registered as Sessions Case No.740 of 2024 pending on the file of the Additional Sessions Judge Pune.

After having heard the matter for substantial time and this

16-ba-677-2025.doc Court having expressed its view of not being inclined, Mr. Siddharth A. Mehta, learned Advocate for the Applicant states that the Chemical Analysis Report in respect of clothes recovered at the instance of the Applicant is still awaited. He on instructions from the Applicant craves leave to withdraw the present application with liberty to file a fresh bail application before the Trial Court after receipt of the Chemical Analysis Report. 4.

Ms. Veera Shinde, learned APP for the State, on instructions from Mr. Sachin Talikote, P.S.I, Khadak Police Station, Pune, submits that the Chemical Analysis Report would positively be received by the prosecution within eight weeks from today and the same will be placed on record of the Trail Court. She therefore submits that upon the Chemical Analysis Report being placed on record, the Applicant can be granted liberty to file a fresh bail Application before the learned Trial Court. Prosecution to act on the statement made by Ms. Veera Shinde, learned APP for the State.

Considering the above, Applicant is at liberty to file a fresh bail application before the Trial Court upon the Chemical Analysis Report being placed on record by the prosecution. If such application is filed, the same be considered on its own merits and in accordance with law.

In view of the above, Bail Application No.677 of 2025 is dismissed as withdrawn with the liberty as prayed for. (ASHWIN D. BHOBE. J.)
